I think the more interesting issue in adding sexual orientation to laws like this is that criteria like race or gender are readily apparent with respect to
most people, while sexual orientation is not. If I punch a gay guy and have no idea he's gay, is that a hate crime? And what if I punch a straight guy who
looks gay to me? Is that a hate crime?
And for those of you who think of legislation like this as a stepping stone for broader rights for gays, does that mean that people who (for instance) oppose gay marriage should also oppose this legislation? |

I don't know what I think of this. Was it the "right" thing to do? Probably. As a gay man, why -wouldn't- I want my attacker to be punished,
and be punished even harder if he only attacked me because I'm gay?
I see the other side too, though. It's an appeasement, and until I read this on this dinky little message board, I didn't even know it had happened. So, I'm not sure exactly how this being signed will "change the public conciousness" - as if the ignorant people that WOULD attack based on sexual orientation are more up-to-date than most people about their laws. And airshowpilot also makes a good point - I always thought it was funny that when they try to make everyone equal they're really just pointing them out as different even more. Anywho - It's good, not great, and kinda blah. :shrug |

I don't think they are trying to make everyone equal. I think it's more 2 fold.
With this new bill... 1. They are trying to give protection to a group of people who have been persecuted by society for many many years based purely on a predisposed genetic make-up... this is not a choice people. With the continuation of this act through the granting of other equal rights... 2. Give this same group access to rights they did not previously have. The passing of this, the FIRST federal gay-rights law is a HUGE fucking deal. It is THE FIRST FEDERAL GAY RIGHTS LAW. If you cannot see this as being a big deal you are just being a devil's advocate for the sake of it and too bad for you. There are many many straight people who will never understand these concepts because they have never been in the position to not have equal rights. Turn on any TV, open a magazine, go for a walk, look around your workplace, classroom etc... the world is STRAIGHT! You have it all and still cannot be happy. That's fucking miserable if you ask me... but that's human nature. Equal rights are not about making everyone the same. They are about giving all different people access to the same rights and right now, not everyone has access tot he same rights and priviedges as everyone else and that is just plain wrong. And come on people... you know this does not mean if someone attacks someone who happens to be gay then it is a hate crime. You know what a hate crime is. People should not be attacking each other regardless. That argument makes you look really ridiculous. But... If you just happen to attack someone and they just happen to be gay, and their lawyers decide to just happen to make it a hate crime case... well then too fucking bad for you. Keep your goddamn hands to yourself for fuck sakes. Any idiot who cannot control themselves to the point of physically attacking anyone deserves what they get. In the end, however, regardless of what laws or bills are passed... there will always be bigots... just as there will always be racists... just as there will always be misogynists... just as there will always be haters... people just learn to hide it better as society tells them that it isn't OK. Unfortunately, the anonymous nature that is this board makes it so that people are free to hate openly and make their flimsy, baiting arguments without actually having to take personal responsibility for that hatred. They do, however, have to live with their hateful selves... which is probably a more fitting level of responsibility. |

Yes! We are all applauding the government for their attempt to discern the intent of an action!!! More specifically hate crimes committed against a specific group based solely on intention. Lawmakers have been doing this for years as our society grows and changes. I know Tee wants our society to stay nice and simple for his simple mind but unfortunately for him... and fortunately for the rest of us, it will continue to change. The American justice system is set up for many reasons, one of them being to discern the intent of an action during a court case. Did you know that there are different degrees regarding murder? There are!... 1st degree, 2nd degree, manslaughter, negligent homicide... There are also diffrent types of Rape... Rape Rape (Whoopi Goldberg's favorite), date rape, spousal rape, statutory rape, gang rape... There are also different types of assault... Simple Assault... Assault and Battery... Aggravated Assault... Felonious Assault... Assault with a Deadly Weapon... Common Assault... Sexual Assault... Malicious Assault... Wanton Assault... There is no one type intent behind one person killing another, just as there is no one intent behind one person assaulting another, just as there is no one intent behind one (or a group of people) raping another. That is why we have people who help to define these different types of crimes to effectively punish the person committing them. There was a time when having one type of murder, rape and assault worked perfectly for society. This is also a time when slavery was legal, women were not allowed to vote and children were allowed to work in factories. I hope that this is extrapolated well enough for all us simpletons here to understand. |

We already try to "discern intent" for actions, though. This is done in murder cases all the time to identify degrees and such.
I think the problem with this is not that it prosecutes based on intent. The question is whether this is truly useful, since these violent crimes result in hard time anyway, and apparently that isn't enough to deter this shitheads. Will the practice of giving out tougher sentences really be enough of a deterrent, especially when violent bigots are so fervent in their motivations? |
