Well, there are two issues in the Roe v. Wade debate, the Federalism question and the precedent question. I think it's possible to believe that
abortion really should be a State issue, but at the same time, not support overturning precedent. And yes, I recognize that a lot people use the Federalism
issue to justify their position on the precedent issue. I don't think it's hypocritical to have a legal philosophy where you support Roe v.
Wade as a precedent but that says that abortion-as an abstract issue in a perfect world-should be decided by the States.
That being said, I have no idea where McCain is on the issue. |

I seem to remember that the states and the federal government treated the laws against blacks marrying whites as a state issue at one time.
And then there was school segration which was a state issue And poll tests were state matters lots of precedent for an issue to become federal rather than state level |

Thank goodness no one would cheat and drive to a state
where abortion is still legal. One of the many reasons Romney is not McCain's vp choice is because Mitt called Johnny out on being pro-choice in 2002. I don't think McCain is as hardcore as Sarah "rape/incest...tough; have the baby" Palin is on the issue. |

Why the hell have the states' rights, strict constructionist people co-opted the "federalist" label? For over 200 years it referred to those who support a stronger federal government, it doesn't even make sense that you would call yourself that if you favor a less powerful federal govt. It's not just them, that's what "federalism" means in France and Britain too. Federalism can go both ways. |
