This wouldn't be the first time. Bruce, Lisi and Sugar where all 'rewarded' with Immunity when they weren't picked for tribes. The difference with those 3 is that they missed Tribal Council because they were all in Exile. Also Lil and Burton were immune at their first Tribal Council even though they had both been voted out of the game.
