So I was driving today and signaled to enter onto the acceleration lane and began to accelerate and look to see if the freeway was clear and smashed into some
jerk stopped at the start of the acceleration lane signaling to merge on. Is this totally my fault like common the jerk should have accelerated right?

let's talk about the time i got hit by a bus.
so i was driving downtown on a three lane (each direction) street and a bus was in the rightmost lane. he signaled left and i was like oh whatever i'm in the leftmost lane. i was driving kind of parallel to the bus, maybe a bit behind. regardless, there is a substantial portion of my car directly beside the bus. so he gets into the middle lane then with no hesitation keeps drifting over to my left lane. i was going pretty fast and when i started to brake to let him in i hydroplaned so i couldn't just smash the brakes. anyway, the tail end of the bus scratched my front bumper. i just kept on driving. buses now terrify me. when i see them near me i leave like 8 car lengths. |

Just a tip for future use: it is almost always your fault when you rear-end someone.

If you can prove the other drive was negligent or should have pulled out of the lane to stop, then you might have a case. If he was just slow to accelerate,
then you're probably totally at fault. Check with the police dept., seriously.

If she was stopped where there was no white stop line, then you may have a case because it's unlawful to drive in a hazardous manner, including going too
slow (or stopping where no stopping is allowed).
If she was stopped at a metered merge (waiting for a green light), then your case may be a draw or your fault. Check with the police/highway dept, but don't admit any guilt (yet). |

It simply depends on whether the lane counts as part of the ramp, where you can stop, or the freeway, where you can't unless you're forced to, and if
the latter then it depends on whether she can prove she was forced to.

Friday I was merging on to the interstate when the exact same thing happened to me. Full ass stop. I didn't smash into the guy, butI slammed my brakes so hard that my anti lock brake light won't go off now and I have to take it in to the mechanic on Monday. Mr. Ontario just sat there with his blank ass stare. Fucka. |
